Ed Jovanovski's contract will not be considered a subsidy.

 

A judge on Tuesday ordered the City of Glendale to turn over internal records of negotiations with potential buyers of the Phoenix Coyotes.

Maricopa County Superior Court Judge Edward Burke ruled the city must turn over documents showing proposed concessions or incentives after potential buyers file their bids for the bankrupt team. The formal bid deadline set by the bankruptcy judge is Friday.

Burke issued his ruling in a lawsuit filed by the Goldwater Institute. The libertarian think tank and advocacy group sued to obtain the documents under the state's Freedom of Information law.

Goldwater views this as a significant victory, although there are quite a few items that will still not be made public according to the Arizona Republic's story on the decision: "For instance, the city does not have to disclose notes taken in meetings, records from negotiations with potential bidders who failed to follow through on a final offer, alternatives the city may be considering in subsequent rounds of negotiations with a bidder, or documents sealed during bankruptcy proceedings."

What happens with the city and potential concessions/subsidies is going to be a major part of how this case is decided, as every "local" bid will be contingent on being able to negotiate some sort of giveback with regards to the arena lease.

As those negotiations with the city get pushed further into the public eye, expect to start to see some more negative press for this whole process. The wide majority of Glendale residents are not Coyotes fans, and their voices could be integral to negotiations later this summer.

But goldwater wanted them even faster. So Goldwater still gets a W, but not as big of one as they hoped.
